Victim of leaked nudes considers legal action

 



Nikitha Cornwall, the young lady who claimed her nude photos were leaked from her phone when she took it to be repaired, is considering legal action against the store.
A statement released yesterday said Cornwall’s attorneys are considering the matter with a view to determining whether to file a civil claim against the parties concerned for money damages on injunctive relief for breach of contract, breach of privacy and other possible civil wrongs.
The statement said the matter has been reported to the Trinidad and Tobago Police Service and the Cyber Crime Unit is investigating the matter for any breach of the criminal law and they will take such action as they deem necessary.
Last week, Cornwall issued a statement on Facebook claiming that her nude photos were leaked by the Bad Robot store in Movie Towne where she took the screen to be replaced.
The owner of the store, Jeffrey Charles, objecting to the bad publicity, shared the pictures on his Facebook page. 
He later apologised for his actions but denied that his store was responsible for leaking the images as the former employee who repaired the phone said he did it in front of the client and did not have access to her phone's password.
In the statement yesterday, Cornwall advised members of the public to take care when taking their devices whether mobile phones, tablets, laptops or personal computers for repair and in particular, to ensure that the repair technicians are reputable and competent persons.
"Whilst no boycott is advocated against the Enterprise concerned, members of the public may want to consider whether that business is a fit and proper place to have their devices repaired," the statement said.
The statement said discussions are now taking place with interested parties with a view to the formation of an advocacy, information and support group, for persons similarly affected.
" Ms Cornwall looks forward to more effective legislation regarding cyberbullying and other cybercrimes," the statement said.
Yesterday, cricketer Lendl Simmons was fined $150,000 for leaking pornographic images of an ex-girlfriend.

  1. If it is found that the store was responsible for the leaked photos then they should be penalized to the full extent possible. This could serve as a future deterrent.
